1. ACCEPTING THESE TERMS

1.1 This document, our rules, policies and the other documents referenced make up our Terms and Conditions (“Terms”). The Terms are a legally binding contract between you and Alaskan Hiker.

 

1.2 This contract sets out your rights and responsibilities when you use our hiking guide.  

 

1.3 Please read them carefully.

 

2. CHANGES

Alaskan Hiker may amend the Terms at any time by posting a revised version. The revised version will be effective at the time we post it. If we change the Terms in a way that reduces your rights or increases your responsibilities, we will provide you with a notification.

 

3. DISCLAIMER

3.1 All forms of outdoor recreation activities have a higher level of risk than most ordinary activities, and therefore can be potentially hazardous and/or dangerous. This includes hiking and especially off-trail adventure hiking. Risk is always a factor in hiking and off-trail adventure hiking, especially when weather is adverse or unpredictable, or when unforeseen events or conditions create a hazardous condition.

 

3.2 For these reasons, it is your responsibility to learn the necessary skills for safe hiking and off-trail adventure hiking. You must assume responsibility for your own actions and safety, exercise sound judgment, be prepared for all conditions, and seek advice on current weather and current trail conditions. These conditions change from day to day, and from season to season, therefore rendering any information on our guide subject to change without warning.

3.3 Although we try to make the information contained on this hiking guide as accurate as possible, we disclaim any liability for accident, loss, injury, inconvenience or any other damage that may be sustained by anyone using the information contained on this hiking guide. Those who use this information, and those who venture onto trails or into wilderness, do so at their own risk. You are solely responsible for using your judgment in interpreting and using this information to safely enjoy your own outdoor pursuits.

 

4. PRICES, AVAILABILITY, AND ERRORS

4.1 The hiking guide e-book on the Site is subject to change without notice. Errors will be corrected when discovered.

 

4.2 Alaskan Hiker reserves the right to correct any errors, inaccuracies or omissions on our site. We reserve the right to rescind our acceptance and cancel your order without penalty in the event there is an obvious and unmistakable error on the site, in our reasonable discretion. If you have already received your order, we will do our best to resolve your concern.

 

5. WARRANTIES

5.1 Alaskan Hiker will provide the hiking guide e-book in accordance with the description, which is set out on the Website.

 

5.2 Alaskan Hiker expects you to take reasonable care to verify that the hiking guide e-book in question will meet your needs.

5.3 Alaskan Hiker does not make any representation, guarantee or commitment to you that the hiking guide e-book will be error free.

6. INTELLECTUAL PROPERTY

At all times, Alaskan Hiker will remain the owner of the intellectual property in the hiking guide e-book.  Other than as specified, the hiking guide e-book may not be reproduced, stored in a retrieval system or transmitted in any form or by any means without the prior written permission of Alaskan Hiker.

7. INDEMNIFICATION

You agree to defend, indemnify and hold Alaskan Hiker harmless from any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use and activities while using the service, including any breach by you of the terms of this Agreement.

 

8. TERMINATION OF USAGE

Alaskan Hiker may terminate your access or suspend your right to access to all or part of the site and/or hiking guide, without notice, for any conduct that we, in our sole discretion, believe is in violation of any applicable law, is in breach of these Terms or is harmful to the interests of other users, Associates, or us.
